BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, known as the Zoning Ordinance, be and the same is hereby amended so as to rezone: A tract of land located at 7511 Shallowford Road, being on the northeast line of Shallowford Road northwest of Ashford Drive. Blocks 23 and 26, Brookshire Subdivision, as shown by plat of record in plat book 12, page 39, ROHC, together with a 40 foot wide unopened right-of-way which separates block 23 from block 26, said subdivision, and the northwest 30 feet of a 40 foot wide unopened right-of-way which separates blocks 23 and 26 from blocks 24 and 25, said subdivision (both streets to be abandoned by case no. 1996-205), and the southwest 20 feet of McCutcheon Road (abandoned by City of Chattanooga Ordinance No. 8405); being the property described in deed book 4083, page 274, ROHC. Tax Map No. 149G-B-8. from RT-1 Residential Townhouse Zone to R-4 Special Zone. SECTION 2. BE IT FURTHER ORDAINED, That this rezoning shall be subject to the following conditions: 1. Proposed use of a congregate retirement residence only with a maximum of 119 units; 2. Dedication of right-of-way as determined by the City Traffic Engineer; 3. Landscape screen along east and west sides; and 4. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage, as provided by law.
